In accordance with the Digital Millennium Copyright Act (DMCA) of 1998 we have adopted and implemented a policy that provides for the removal of any infringing material from our memorial website platform. This policy outlines our procedures for addressing copyright infringement claims and our commitment to protecting both copyright holders and our users rights under applicable law

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our memorial platform please notify our designated copyright agent as specified below. To be effective under the DMCA your notice must include all of the following information

Required Information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  • Identification of the copyrighted work claimed to have been infringed or if multiple copyrighted works are covered by a single notification a representative list of such works
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit us to locate the material
  • Information reasonably sufficient to permit us to contact the complaining party such as an address telephone number and email address
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner its agent or the law
  • A statement that the information in the notification is accurate and under penalty of perjury that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

How to Report Content

To report content, email us the full URL of the specific photo, video, or post you are reporting.

Each piece of user-generated content on our platform has a unique, addressable URL that allows us to quickly locate and take action on reported items. When you click on a photo or video in a memorial gallery, the browser URL will update to include a specific identifier for that content.

Steps to Report:

  1. 1. `Navigate to the memorial page containing the content you wish to report`
  2. 2. `Click on the specific photo, video, or post to open it`
  3. 3. `Copy the full URL from your browser's address bar`
  4. 4. `Email that URL along with your DMCA notice containing all required elements to dmca@leftthis.world`

This URL-based reporting system ensures we can immediately locate the exact content you're reporting and take appropriate action within our required response timeframes. We will respond to valid DMCA notices within 48 business hours.

Filing a Counter-Notice

If you believe that material you posted was wrongfully removed due to a mistake or misidentification you may file a counter-notice. Upon receipt of a valid counter-notice we will forward it to the party who submitted the original takedown notice. The original complainant then has 10 business days to file a court action to enjoin further infringement. If no such action is filed we may restore the removed material. Your counter-notice must include

Counter-Notice Requirements:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
  • Your name address and telephone number and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located or if your address is outside of the United States for any judicial district in which we may be found and that you will accept service of process from the person who provided notification or an agent of such person

Repeat Infringer Policy

Left This World Memorial Ltd has adopted a policy of terminating in appropriate circumstances and at our sole discretion users who are deemed to be repeat infringers. We may also at our sole discretion limit access to our service and/or terminate the accounts of any users who infringe any intellectual property rights of others whether or not there is any repeat infringement. We reserve the right to suspend or terminate access to our memorial platform for users who violate copyright laws or our terms of service

Warning About False Claims

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, copyright owner, or their authorized licensee. Courts have awarded damages exceeding $100,000 for false DMCA claims. Do not make false claims. Submitting a DMCA notice under penalty of perjury with false information is a federal crime.
